This privacy policy (“Privacy Policy”) governs the processing of your personal data by Amista as data controller, with registered office at Duwijckstraat 17, 2500 Lier (“we”, “our”), listed with the CBE (Crossroads Bank for Enterprises) under number BE0555993013 in accordance with the applicable legislation relating to the protection of personal data. 

This Privacy Policy is applicable to the use of our Website (www.amista.com) as well as to every interaction you may have with Amista as customer, prospect, partner, candidate,…  

We reserve the right to change the Privacy Policy. Such changes will be communicated through the Website. 

This Privacy Policy was last updated on 13 June , 2024. 

  1. Which data, why and on which basis? 

Which information we collect depends on the context of your interaction with us, the method of contacting us and the information you provide: 

  1. when you request a quote or place an order: Name; First name; E-mail address; Phone number (landline/cell phone); Fax number; Company address; Function and capacity; Company name. We process this information in order to prepare and send you the quote or to deliver the products or services which you requested, based on consent or contractual obligations.  
  2. when filling in the contact form on the website: Name; First name; Company Name; E-mail address; Phone Number; Topic which relates to your question; Your message.  We process this information to reply to your request based on your consent and our legitimate interest. 
  3. when registering for the newsletter: We process this information for direct marketing purposes, i.e. to be able to provide you with targeted communication, promotional and other offers and any other advertisements that we or our selected partners may have available based on your consent or if you’re a customer based on our legitimate interest. 
  4. when visiting our offices or trade fair stand or when exchanging business cards: the personal data you provide to us. We process this information in order to reply to your request based on your consent or for prospection based on our legitimate interest. 
  5. when engaging with us through our social media or by email or telephone; Name; First Name; E-mailaddress (if applicable); Phone Number (if applicable). We process this information in order to reply to your request based on your consent or for prospection based on our legitimate interest. 
  6. when applying for a vacancy or in case of a spontaneous application: Name; First Name; Email address; Phone; Resume; Cover Letter We process this information in order to consider your application based on your consent or our legitimate interest.

  1. With whom do we share personal data?

We do not send your personal data to third parties in a way that you can be identified without your express permission to do so if this is not necessary to provide the services. 

In certain cases, however, we may have to disclose your personal data pursuant to a court order or to comply with other compulsory laws or regulations. We will make reasonable efforts to inform you in advance in this regard, unless restricted by law.  

Reorganisation or transfer of all or part of our business, where we reorganise, transfer, discontinue or if we become insolvent, may involve the transfer of your data to new entities or third parties that take over all or part of our business. We will make reasonable efforts to notify you in advance if we disclose your data to such third parties, but you also acknowledge that this may not be technically or commercially feasible in all circumstances, or may not be permissible in certain cases.   

 We can rely on external processors to offer the Website and/or services to you. We ensure that third-party processors may only process your personal data on our behalf and pursuant to our written instructions. We guarantee that all external processors are selected with the necessary care, so that we can rest assured of the security and integrity of your personal data. 

We can transmit anonymised data to other organisations that can use these data to improve products and services, and to organise bespoke marketing, presentation and the sale of products and services. 

  1. Where do we process the personal data?

We and our external processors will only process your personal data in the EEA. 

We can transfer our anonymised and/or aggregated data to organisations outside the EEA. If such transfer is made, we shall ensure that there are appropriate guarantees to warrant the security and integrity of your personal data, and that all personal data rights that you might enjoy under applicable mandatory law are guaranteed. 

6. How we process the personal data? 

We will do our utmost best to process only the personal data necessary to achieve the objectives stated in this Privacy Policy. We will process your personal data lawfully, honestly and transparently. We will do our utmost best to keep the personal data accurate and up to date. 

Your personal data will only be processed as long as necessary to achieve the objectives stated in this Privacy Policy or until the moment at which you withdraw your processing permission. Remember that withdrawing the permission can imply that you will no longer be able to use all or part of the Website and/or services.  

We will take appropriate technical and organisational measures to keep your personal data secure from unauthorised access or theft and from unintentional loss, manipulation or destruction. Our personnel or the personnel of our external controllers will only be able to gain access on a need-to-know basis and this is subject to strict obligations of confidentiality.  

Unfortunately, no risk can be completely avoided. If unauthorized access is gained to our IT systems, we will immediately take all possible measures to minimize damage to and/or theft of the data and inform the parties involved. 

7. How long do we keep the personal data? 

The retention periods vary depending on the nature of the service provided. We keep your data: 

  • as long as necessary for the purposes for which it is collected and processed, usually max up to 12 months. 
  • Resumes we receive from candidates we do not consider suitable will be immediately removed from our systems. Resumes of candidates whom we consider suitable but who are not (or cannot be) selected immediately we may retain for a period of 1 year if the applicant gives his/her consent.   
  • as long as necessary to comply with our legal, contractual and legal obligations and to fulfill our commercial operational activities. 

8. Your rights 

You have the right to request access to all the personal data that we process of you.  

You have the right to request that any personal data about you that is incorrect or inaccurate be corrected free of charge. 

You have the right to withdraw previously granted permission for the processing of your personal data. You can withdraw your permission at all times by sending an email to info@amista.be. 

You have the right to request that personal data relating to you be removed if this is no longer needed in the light of the objectives that are outlined in this Privacy Policy or if you withdraw your processing permission. However, you must consider that a removal request to us will be assessed in the light of statutory or regulatory obligations or administrative or judicial orders, which may prevent us from removing the respective personal data. 

Instead of requesting removal, you can also request that we restrict the processing or your personal data if (a) you dispute the correctness of such data, (b) the processing is unlawful or (c) the data is no longer necessary for the objectives stated but you need it to defend yourself in judicial proceedings. 

You have the right to object to the processing of personal data if you can show that there are serious and justified reasons regarding special circumstances warranting such an objection. However, if the envisaged processing is noted as direct marketing, you have the right to object to such processing free of charge and without giving any reason for this. 

If your personal data is processed on the basis of permission or on the basis of a contract where the data is processed automatically, you have the right to receive the personal data provided to us in a structured manner and in a generally used format that can be read by a machine and, if technically possible, you have the right to directly transmit such data to another service provider. We will be the only persons to assess the technical viability of this. 

If you wish to submit a request to exercise one or more of the above-mentioned rights, you can send an email to info@amista.be. Such request must clearly state what right you wish to exercise and why. We will notify you immediately when such request has been received. If it appears that the request is founded, we will grant the request as quickly as is reasonably possible and no later than thirty (30) days after the request has been received. Additional legitimation regarding your identity could be requested.
